Last Will & Testament
A Last Will and Testament is a legal document that states your desires and wishes for the distribution of your assets and wealth properly upon your death. If you have children, a properly drafted will also allow you to designate who will care for them upon your demise. If you do not have a will, your assets will be distributed according to Arizona state laws (or the state of legal residence) and the courts. In the event you die without a will, your assets would likely be distributed to your legal spouse, children, parents, or other close relatives. In other words, the state will determine the beneficiaries of your estate.
It is important to note that using a will may not allow your estate to avoid probate. Evergreen Estate Planning will discuss this option with you on the phone or in person and decide together if this is the best way to handle your estate or if a Trust is a more viable solution.
